1. Acceptance of these Terms

By downloading, accessing, creating an account, or using ScrollRace, you agree to these Terms of Use and to our Privacy Policy.

If you do not agree to these Terms, do not use ScrollRace.

2. Who we are

ScrollRace is operated by the owner of the ScrollRace app and the domain scrollraces.com.

3. App Store terms

If you download ScrollRace through the Apple App Store, your use of the app may also be subject to Apple's applicable terms, including Apple's Licensed Application End User License Agreement, unless a separate custom license agreement applies.

These Terms govern ScrollRace-specific rules, including accounts, usernames, leaderboards, race validation, anti-cheat enforcement, and acceptable use.

4. Eligibility

You may use ScrollRace only if you are legally allowed to use online services in your country or region and can comply with these Terms.

If you are under the age required by applicable law to use online services without parental consent, you may use ScrollRace only with the consent and supervision of a parent or legal guardian.

5. Accounts

Some features of ScrollRace may require an account, including profiles, saved records, leaderboards, friend features, country rankings, and account-based race history.

You agree to:

• Provide accurate account information.
• Keep your login credentials secure.
• Not share, sell, transfer, or misuse your account.
• Notify us if you believe your account has been compromised.

You are responsible for activity that occurs through your account.

6. Usernames and profile information

Usernames and certain profile information may be visible to other users through profiles, leaderboards, rankings, friend features, or invite features.

You may not use a username or profile information that:

• Is offensive, hateful, abusive, harassing, or discriminatory.
• Impersonates another person, brand, organization, or public figure.
• Contains personal information such as email addresses, phone numbers, or addresses.
• Promotes illegal activity, scams, spam, or harmful behavior.
• Violates intellectual property, privacy, or other rights.

We may remove, change, restrict, or refuse usernames or profile information that violate these Terms or that we consider inappropriate for ScrollRace.

7. Races, results, and leaderboards

ScrollRace allows users to complete races by scrolling and to compare race results through records, rankings, and leaderboards.

Race results may include race time, average speed, peak speed, personal bests, weekly records, all-time records, ranking position, country ranking, friend ranking, and related statistics.

Leaderboards are competitive features. They are not guaranteed to be permanent, perfectly accurate, always available, or free from delay, error, manipulation, technical issues, or calibration differences.

8. Device calibration and result accuracy

ScrollRace may use device model, screen characteristics, operating system behavior, and other technical information to estimate scroll distance and calculate race performance.

Results may vary based on device type, screen size, refresh rate, input behavior, operating system performance, browser or app environment, hardware limitations, and calibration data.

We do not guarantee that race results, speeds, distances, rankings, or comparisons are perfectly accurate across all devices or users.

9. Anti-cheat and fair play

You agree to use ScrollRace fairly and not attempt to manipulate race results, rankings, leaderboards, account data, device calibration, or app behavior.

You may not:

• Use bots, scripts, macros, automation, emulators, or artificial input tools to complete races.
• Modify, reverse engineer, tamper with, or exploit the app or its systems.
• Submit fake, manipulated, impossible, or misleading race results.
• Interfere with race validation, device calibration, or anti-cheat systems.
• Abuse bugs, glitches, timing issues, network behavior, or database behavior.
• Use multiple accounts to manipulate rankings, invitations, friend features, or leaderboards.
• Attempt to access another user's account or data.

We may analyze race data, device data, input timing, scroll patterns, peak speeds, and other signals to detect suspicious activity. We may flag, hide, delete, review, or reject race results that appear suspicious, impossible, automated, manipulated, or unfair.

We may also suspend or terminate accounts that violate these Terms or harm the fairness, security, or integrity of ScrollRace.

10. Acceptable use

You agree not to:

• Use ScrollRace for unlawful, harmful, abusive, or fraudulent activity.
• Harass, threaten, abuse, impersonate, or target other users.
• Upload, submit, or share harmful code, spam, scams, or malicious content.
• Attempt to disrupt, overload, scrape, attack, or compromise our systems.
• Use ScrollRace in a way that violates applicable laws or third-party rights.
• Copy, resell, rent, sublicense, or commercially exploit ScrollRace without permission.

11. Friend, invite, and social features

ScrollRace may include friend features, invite codes, profile sharing, or leaderboard scopes such as world, country, and friends.

You are responsible for how you share invite links or profile information. You must not use these features for spam, harassment, impersonation, or unauthorized marketing.

12. Advertising

ScrollRace may display ads or use advertising services. Ads may be provided by third-party advertising partners and may be subject to those partners' own terms and privacy practices.

You must not manipulate ad systems, generate fraudulent ad impressions or clicks, or interfere with ad delivery or measurement.

14. Virtual items, rankings, and app features

ScrollRace may include visual themes, arenas, rankings, statistics, records, achievements, or other in-app features.

These features are provided for entertainment and may be changed, limited, reset, removed, or discontinued at any time. You do not own leaderboard positions, rankings, usernames, visual features, or app-generated statistics.

15. Account deletion

You may delete your account through the app where account deletion is available.

If you cannot access the app, contact: contact@ooptifood.com.

Deleting your account may remove your profile, username, race history, leaderboard data, and related account data, subject to legal, security, fraud-prevention, backup, or dispute resolution retention requirements.

16. Privacy

Our collection and use of information is described in our Privacy Policy.

By using ScrollRace, you acknowledge that we may process data needed to provide accounts, leaderboards, race validation, device calibration, anti-cheat systems, support, analytics, and other app functionality as described in the Privacy Policy.

17. Intellectual property

ScrollRace, including its name, branding, design, software, code, graphics, images, text, gameplay concepts, interfaces, logos, and other content, is owned by us or our licensors and is protected by intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use ScrollRace for your own personal, non-commercial entertainment use, subject to these Terms.

You may not copy, modify, distribute, sell, reverse engineer, decompile, scrape, or create derivative works from ScrollRace except where permitted by applicable law.

18. User feedback

If you send us ideas, suggestions, bug reports, feature requests, designs, or other feedback, you grant us the right to use that feedback without restriction or compensation to you.

19. Third-party services

ScrollRace may rely on third-party services for authentication, database hosting, app distribution, advertising, analytics, crash reporting, email delivery, hosting, or other functions.

We are not responsible for third-party services, websites, policies, or practices. Your use of third-party services may be subject to their own terms and privacy policies.

20. Availability and changes to the app

ScrollRace may be updated, modified, interrupted, suspended, or discontinued at any time. We do not guarantee that the app, accounts, leaderboards, records, statistics, support, or any feature will always be available, error-free, secure, or uninterrupted.

We may add, remove, modify, rebalance, reset, or limit features, rankings, rules, calibration systems, anti-cheat systems, or leaderboard logic at any time.

21. Suspension and termination

We may suspend, restrict, or terminate your access to ScrollRace if we believe you have violated these Terms, created risk, harmed other users, attempted to cheat, abused the service, or used ScrollRace unlawfully or unfairly.

We may also remove, hide, reset, or modify race results, rankings, usernames, profiles, or other app data where necessary to protect the app, users, or leaderboard integrity.

22. Disclaimers

ScrollRace is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

We do not guarantee that ScrollRace will be uninterrupted, secure, error-free, free of cheating, free of bugs, or perfectly accurate across all devices.

23. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of rankings, loss of records, loss of goodwill, device issues, account issues, or inability to use the app.

To the maximum extent permitted by law, our total liability for any claim related to ScrollRace will be limited to the amount you paid directly to us for ScrollRace in the twelve months before the claim, or 50 EUR if you paid nothing.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

24. Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of ScrollRace, violation of these Terms, violation of law, cheating, manipulation, or infringement of third-party rights.

25. Governing law

These Terms are governed by the laws of France, unless mandatory consumer protection laws in your country or region require otherwise.

If you are a consumer in the European Union, you may have mandatory rights under the laws of your country of residence that cannot be limited by these Terms.

26. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we may notify users through the app, website, or other appropriate means.

The updated Terms will be posted on this page with a new effective date. Continued use of ScrollRace after the updated Terms become effective means you accept the updated Terms.
